THE BLIND DATE

Four single people went for a night out on the 6th February 2009 on a pre-arranged double blind date, we met after my co accused Mark Cleminson (“MC”) had received text messages (SMS)

from Carrie Ann Proctor “C.P” in turn received many texts from “MC”  These texts messages were all on 02 networks ‘so texts were free’ and there were many and they were of a banter that I would say were sexual and flirty she “C.P” started texting “MC”  three days before we all met up ,

 

(I can name “CP” as she was a co accused and all three of us eventually charged with ‘Conspiracy to pervert the course of public justice’ a very serious charge  I was also charged with one count of  sexual assault  ) We picked up “CP” first, just outside Kendal and  she text her best friend (“BF”) to say we are on the way to your house have you got a baby sitter , she texted back don’t bring them to my house stop at Kendal collage the bottom of my road we got to the collage and “CP” went to collect her  “BF” “CP” told us there is a off-licence around the corner go and get some drinks for the journey to Morecambe she then went to get her “BF” nr  Kendal collage Cumbria.  Mark contacted me the day before to say he had two birds in Kendal who wanted a night out in Morecambe is 30 miles from Kendal do you want to come with me as I have no car and you do, I said to Mark how old are these birds he said they are both 18 they were in fact 17 but both had birthdays in February that would of made them 18 two weeks after this blind date hence why they told the first little lie? The age of consent in England  is 16  so no laws broken Mark was 42 & I was 52   I know this is the tawdry bit, Mark said he was 37, and  I 45 two more little lies ! Both girls new this before they come out with us it was in the SMS (mobile devices that were seized by Cumbria police   when the girls came down the road they could see us both sitting in the front of the car “BF” give a little wave and both girls got in the back of the car    We give the girls a bottle of WKD each and said which way to Morecambe girls? They directed us to the M6 and it took about 20 minutes to get there approx 30 motorway miles just before Morecambe “CP” said she needed the toilet urgently so I seen a car park with what looked like toilets on them and pulled in “CP” “BF” got out the back and went for a pee “MC” got out of the front of the car and sat in the back seat the girls got back in the car “CP” in the back and “BF” in the front “MC” & “CP started messing about and were kissing. The “BF” and I started talking the banter was mainly about her ex boy friend who  she had the baby to she said he had left her and taken money that was given to her daughter for drugs  she said he took cocaine and also admitted using this herself when she lived with him in Folkestone in Kent she also divulged to the car that she used to go to sex parties with him and much older couples  and they would get free cocaine from these parties   while living in Kent. “CP” announced that she was hungry and “MC” said no drink left lets go into Morecambe we said do you want to go to pub No they all agreed to have takeaway so we found a KFC on the front with a large supermarket opposite I give the girls some money to get what they wanted at KFC “MC” went and purchased more drink at the supermarket I stayed with the car “MC” got back first then the girls got back in the same positions in the car. We just went back to the same car park as “BF” did say I need to be back in about a hour for my mum is babysitting my baby who she named. So back at the car park we did eat the KFC and I had a can of beer only one “CP” and “MC” got on really well and “CP” agreed to come back to “MC” house in Carlisle during petting after the KFC. “I asked “BF” if she would like a kiss she agreed and we met half way and kissed this was confirmed in statements by “CP” & “MC” and was also in my account  while we were kissing I put my hand on her just below her breasts while kissing my hand slowly went down past her navel towards her pubic bone she broke off the kiss and announced “ I am on “ I knew right away what she meant menstruating so moved my hand back to her navel area PDQ  the button on the top of her jeans could not fasten as she had her baby about 6 weeks earlier I did comment on her stretch marks  that I felt around her waist and said keep them bits creamed up to get rid of them? As we sat there she received a text  (SMS) off her MUM she read this out to the car Carrie she shouted Mums just sent me this “HOME NOW SLAG” I started the car right away as the girls said mum was the angry type and not to be messed with on the drive back “BF” and I were getting on well and she put my mobile number in her phone and her number in mine during the journey I was holding her leg some of the way on the motorway and saying we could all go out again sometime if she wanted she did agree with this when we got to Kendal collage she kissed me on the cheek and thanked us all then quickly ran home , “CP” said can we go to my mum’s house so I can pick up some fresh clothes if I am to stay with you over the weekend Mark. While we were in the car outside “CP” house her mum sent a message to see if Mark would lend her £10 to get some electricity on her card meter he give “CP” the £10 she ran back and give this to her mum who waved her off while on the M6 motorway back to Carlisle “CP” received a phone call from “BF” saying where are you “CP” she said on the M6 going to my new boyfriends house I am worried about you she said to “CP” I will be ok .The Police officer at “BF” house said he heard Welsh say “sorry for touching you let’s just be friends” I and the others denied this it transpires that in his note book that has the 7 pages of the no crime first account of “BF” he does not mention this apology that he give in his testimony at trial Later down the M6    I was pulled over by a T5 Police car, followed by three other cars and a van the first officer at the car said to “CP” you are safe now “CP” snapped at him what are you on about? He said your “BF” as been sexually touched and I was arrested on suspicion of sexual assault. Mark was also arrested then bailed pending further inquires and “CP” taken back to Kendal I stayed the night in Kendal Police stn and interviewed the following evening Saturday night by DC West. I never denied touching “BF” and said I had consent and the others were commenting while we kissed they did not see this touch that I admitted to but did confirm in statements Stan asked “BF” for a kiss and “BF” said yes they met half way said missing eye witness “CP” and kissed she did not see any concern at the time with her “BF” and neither did “MC” or myself to the contrary I said she was happy to be kissed and touched but did say I am on my period so I took this as don’t go any further so I did not .Took her home very quickly when she received the  rude text off her mum “HOME NOW SLAG”

“I will not name the accused and I do not blame her for this alleged injustice” I blame the controllers of the exhibits Police/CPS (with the cards on the table) selecting the best and “EDITING” the main statements, Hid the no crime first account statement that was asked for at trial and could not be found ? Seized mobile devices a medical and social services reports that could only assist the defence at or prior to trial / appeal? & I now say I categorically did not get a fair process or trial under my rights of the ECHR Article 6.1 says if the Police /CPS withhold relevant evidence from the defence this is simply not a due and fair process from beginning to last?
